- That failure of the RENTER
to pay the obligation after the expiration
of this agreement shall make him liable for
the payment of interest per annum without
need of any demand.
- That the RENTER participates
as an insured under an automobile insurance
policy, a copy of which is available for inspection
by the RENTER at the headquarters office of
the COMPANY. Said policy contains coverage
in respect of third party body injury or death
liability and property damage liability up
to a limit of P50,000.00. The RENTER is bound
by and agrees to the terms and conditions,
thereof is being understood by the RENTER
that the policy is a standard motor vehicle
policy in accordance with the laws of the
Philippines. The RENTER agrees further to
protect the interests of the COMPANY and the
insurance company of herein FILCAR SERVICES,
INC. in case of accident during the term of
this rental by:
- Not admitting liability
or guilt;
- Obtaining names and
addresses of parties and of witnesses;
- Not abandoning said
vehicle without adequate provisions for
safeguarding and securing same;
- Upon the expiration of the
stipulated period of rental, the renter shall
immediately return the vehicle, herein rented;
should he fail to do so, he shall pay in the
form of a penalty, an additional 20% of the
accumulated charges until the vehicle shall
have been returned to the COMPANY:
- Giving a detailed report
including diagram even in case of slight
damage; and within 24 hours inform the COMPANY
personally or by telephone thru the nearest
COMPANY station of such accident.
- Notifying the police immediately
especially if another party's guilt has
to be ascertained and/or if people are injured.
- That the RENTER declares
that no COMPANY or Underwriter in connection
with Motor insurance for RENTER has at any
time:
- Decline any of his proposals;
- Required the RENTER to
carry the first portion of any loss;
- Refused to renew any policy
- That the RENTER hereby releases
the COMPANY of and from any liability for
loss or damage to any property left, stored
or transported by RENTER or any other person
or upon vehicle before or during the term
of this rental or after return of the vehicle
of the COMPANY. The RENTER further agrees
to hold the COMPANY harmless from and to defend
and indemnity the COMPANY against all claims
and costs based upon on arising out such damage.
- That the COMPANY while taking
all the precautions and using its best efforts
to prevent such happening, shall not be liable
for mechanical failure of said vehicle or
consequent damages. The RENTER shall not make
any claim for damages against the COMPANY
or delay through break down accident and that
the RENTER shall not authorize anybody to
repair and/or change part of the car without
the prior knowledge and written approval of
the COMPANY.
- RENTER shall not assign,
sell, mortgage, pledge, change or alter this
agreement or the vehicle or the lock equipment
or any part or parts of the vehicle or otherwise
deal with the same in any manner inconsistent
with Leaser's ownership, when not in use renter
shall always lock said vehicle.
- In the event of the RENTER
hiring a roof lack for use on the said vehicle,
he hereby releases the COMPANY from and against
all or any liability for damages or claims
arising directly or indirectly out of the
use thereof;
- The additions to or alterations
of the terms and conditions of this agreement
shall be null and void unless agreed upon
this writing;
- That this agreement shall
be continued in accordance with the laws of
the Philippines.
- That this parties herein
agree to adopt all the stipulations/terms
and conditions appearing in the front page
of this AGREEMENT as an integral part hereof;
- In case collection of the
RENTER's obligation shall be referred to a
lawyer, it is agreed that 10% of such obligation
shall be due as attorney's fees provided that
in case of suit arising out of and in connection
with this agreement venue of which is agreed
upon to be in the City of Manila. It is agreed
that attorney's fees, shall be paid at the
rate of 25% of the amount due but in no case
it be less than P100.00.
